Rates verified for April 2026. Pay must rise from the trigger date when BOTH conditions are met (year 1 complete AND age threshold). Underpayment back-pay claimed via the employment tribunal (unlawful deductions, Section 23 ERA 1996) is capped at the most recent 2 years of underpayment since the Deduction from Wages (Limitation) Regulations 2014. A separate civil-court breach-of-contract route allows recovery for up to 6 years under the Limitation Act 1980, and HMRC NMW Enforcement Officers can also pursue full-period arrears independently.

Apprenticeship Levy + funding

  • Employers with £3m+ pay bill - pay 0.5% Apprenticeship Levy. Funds go into digital account, must be used within 24 months for apprenticeship training. Many large employers have unused balances.
  • Employers with under £3m pay bill - don\'t pay levy. Government co-invests 95% of apprenticeship training costs; employer pays 5%.
  • Existing employees can become apprentices - the levy can fund retraining of current staff. Apprenticeships don\'t require being a new hire. Some employees pursue Level 6 / Level 7 (degree / master\'s) qualifications via the levy as career development.
  • Levy transfer - large employers can transfer up to 50% of their unused levy to other employers (typically smaller businesses in their supply chain).
  • End-point assessment funding - the levy / co-investment covers training + the end-point assessment. Apprentice doesn\'t pay anything.

  • Track your pay trigger date - the day after year 1 + your 19th/21st birthday, pay must rise. Watch payslips; underpayment is common employer error.
  • Document off-the-job training time - keep a log of training hours. 20% requirement is enforceable; underprovision is a serious breach of apprenticeship rules.
  • Use Apprenticeship Levy as career development - if you\'re an existing employee at a large employer, ask HR whether the levy can fund a degree apprenticeship or professional qualification for you. Often un-spent budget exists.

Are apprentices full employees with all rights?

Can my employer terminate the apprenticeship early?

Restricted. Approved English Apprenticeship contracts are NOT standard employment contracts that can be terminated on notice. They're service contracts where the employer commits to training to the end-point assessment. Termination requires: (a) the apprentice's consent, (b) breach by the apprentice fundamental enough to justify termination, (c) genuine redundancy of the apprentice role + the employer cannot retain the apprentice, (d) the employer ceasing to be able to deliver the apprenticeship. Wrongful termination = damages including the value of training + qualification + lost earnings. Stronger protection than typical employee dismissal pre-2-year service.

How does the Apprenticeship Levy work?

Employers with annual pay bills above £3m pay an Apprenticeship Levy of 0.5% of their pay bill (minus a £15,000 levy allowance). Funds go into a digital account that the employer must use for apprenticeship training within 24 months or it expires. Small employers (under £3m pay bill) don't pay the levy but receive co-investment for apprenticeship training (typically 95% government / 5% employer). The Apprenticeship Levy has been criticised for under-spending - lots of accumulated balances expire unused. What happens if the apprenticeship doesn't lead to qualification?

End-point assessment (EPA) determines pass / fail. Failing EPA: apprentice can retake (sometimes at additional employer cost), or the apprenticeship terminates without qualification. The apprenticeship contract typically converts to an ordinary employment contract on completion - so a failed EPA doesn't automatically end employment, but it does mean no qualification. Some employers commit to keeping apprentices regardless of EPA outcome; others restructure. Discuss + clarify this at the start. Some apprentices then complete the EPA after the apprenticeship via separate arrangement.

What rights when an apprentice transfers to a new employer?

If the apprentice is moved between employers (e.g. employer sells the business), TUPE protections apply - the apprenticeship contract transfers + service continues. If the apprentice leaves voluntarily mid-apprenticeship, the apprenticeship typically ends; they can transfer to a new employer's apprenticeship scheme but starting fresh. The qualification credits + completed off-the-job training are personal to the apprentice + can be carried to a new programme + provider, but the apprenticeship "clock" restarts unless the new employer agrees to continue the existing apprenticeship.
